Qumpra.com enables customers to place orders digitally while Qumpradors independently carry out the physical sourcing and buying of goods from public markets.

2. ACCEPTANCE OF TERMS

By creating an account, placing an order, browsing products, or using any feature of the Platform, you confirm that:

  • You are at least 18 years old, or are using the Platform with the consent of a parent or legal guardian
  • You have read, understood, and agreed to these Terms
  • You agree to comply with all applicable Philippine laws and regulations

3. SERVICE SCOPE

Qumpra.com:

  • Acts as a digital marketplace and coordination platform, not the direct seller of goods unless expressly stated
  • Connects customers with independent vendors, merchants, and Qumprador personal shoppers
  • May provide logistics coordination, delivery facilitation, and digital wallet features

Product availability, pricing, weight, and quality may vary based on daily market conditions and vendor supply, despite reasonable efforts to ensure accuracy and quality.

4. USER ACCOUNTS

4.1 Account Registration

Users may be required to create an account and provide accurate, complete, and updated information.

4.2 Account Responsibility

You are responsible for:

  • Maintaining the confidentiality of your login credentials
  • All activities conducted under your account

Qumpra.com is not liable for losses arising from unauthorized account use.

5. ORDERS, PRICING, AND WEIGHT VARIATIONS

5.1 Approximate Weights

Some products (e.g., meat, poultry, seafood) are sold on an approximate weight basis.

  • Final pricing may be adjusted based on actual weight
  • Any overpayment or underweight difference may be refunded via Qumpra Wallet, store credit, or other methods disclosed at checkout

5.2 Pricing Accuracy

Prices may change without prior notice due to market conditions. In the event of pricing errors, Qumpra.com will make reasonable efforts to notify customers and may adjust or cancel affected orders in accordance with applicable consumer protection laws.

6. PAYMENTS

Accepted payment methods may include:

  • Online payment gateways
  • Cash on Delivery (COD)
  • Qumpra Wallet (if available)

All payments are subject to verification. Qumpra.com reserves the right to refuse or cancel transactions suspected of fraud or abuse, subject to applicable laws.

7. DELIVERY AND PICKUP

  • Delivery times are estimates and may be affected by weather, traffic, vendor readiness, or force majeure
  • Qumpra.com is not liable for delays beyond reasonable control
  • Customers must ensure accurate delivery details

Failure to receive an order due to incorrect or incomplete information may result in forfeiture or additional charges, subject to applicable consumer protection laws.

8. CANCELLATIONS, RETURNS, AND REFUNDS

  • Before vendor or Qumprador sourcing begins
  • Subject to platform-specific cutoff times

8.2 Perishable Goods

Due to the nature of fresh and perishable items:

8.3 Refund Method

Approved refunds may be issued through:

  • Original payment method
  • Qumpra Wallet
  • Store credits

All refunds are subject to applicable Philippine consumer protection laws.

9. QUMPRA WALLET

The Qumpra Wallet:

  • Is a non-interest-bearing digital wallet
  • May be used for refunds, promotions, or future purchases
  • Has no cash value, except where required by law
  • Is non-transferable unless explicitly allowed

Qumpra.com may impose reasonable limits or conditions on wallet usage.

10. USER CONDUCT

Users agree not to:

  • Provide false or misleading information
  • Abuse vendors, Qumpradors, riders, or platform staff
  • Use the Platform for illegal, fraudulent, or harmful purposes
  • Attempt to disrupt or exploit the Platform’s systems

Violations may result in suspension or permanent termination, subject to due process where required by law.

11. INTELLECTUAL PROPERTY

All content on Qumpra.com — including logos, text, graphics, photos, and software — is owned by or licensed to Sapong Enterprises.

Unauthorized use, reproduction, or distribution is prohibited.

12. THIRD-PARTY VENDORS, MERCHANTS, AND QUMPRADOR PERSONAL SHOPPERS

Qumpra.com works with independent public market vendors, merchants, and Qumprador personal shoppers (collectively, the “Third-Party Providers”) to fulfill customer orders.

12.1 Independent Contractor Relationship

  • Qumprador personal shoppers are independent contractors, not employees, agents, partners, or representatives of Sapong Enterprises or Qumpra.com
  • Qumpradors independently control the manner, timing, and means by which they perform their services, including sourcing decisions
  • Any platform guidelines relate solely to safety, service quality, and customer protection and do not dictate specific methods of performance
  • Qumpra.com does not control daily schedules, tools, routes, or work methods of Qumpradors, consistent with Philippine DOLE independent contractor principles
  • No employer-employee relationship is created regardless of compensation structure, market matching, or order volume

12.2 Consideration and Matching

Qumpra.com may facilitate the matching or availability of Qumpradors to customer orders but does not require Qumpradors to accept any specific task.

12.3 Role of Qumpra.com

Qumpra.com:

  • Operates as a digital marketplace and coordination platform
  • Facilitates order placement, communication, payments, and issue resolution
  • Does not directly sell, prepare, or physically handle market goods unless expressly stated

12.4 No Guarantee of Product Outcomes

Due to the nature of public markets and fresh goods:

  • Qumpra.com does not guarantee availability, exact weight, uniform appearance, or fixed pricing
  • Variations may occur due to daily market conditions
  • Reasonable substitutions may be made in accordance with platform policies and customer preferences

12.5 Product Information and Reasonable Diligence

Product listings are based on vendor information and prevailing market conditions. Qumpra.com exercises reasonable diligence but is not responsible for inaccuracies inherent to market variability.

12.6 Disputes and Mediation

  • Issues must be reported through Qumpra customer support
  • Qumpra.com may facilitate reasonable mediation in good faith
  • Legal claims, if any, remain between the customer and the concerned Third-Party Provider, subject to Philippine law

12.7 Limitation of Responsibility

To the fullest extent allowed by law, Qumpra.com shall not be liable for:

  • Characteristics inherent to fresh or perishable goods
  • Acts or omissions of Third-Party Providers
  • Market shortages, substitutions, or price changes

13. DISCLAIMER OF WARRANTIES

The Platform is provided “as is” and “as available.”
Qumpra.com makes no warranties regarding uninterrupted service, accuracy of listings, or fitness for a particular purpose, except as required by law.

14. LIMITATION OF LIABILITY

To the fullest extent permitted by Philippine law, Sapong Enterprises and Qumpra.com shall not be liable for indirect, incidental, or consequential damages arising from the use of the Platform.

15. INDEMNIFICATION

You agree to indemnify and hold harmless Sapong Enterprises from claims arising from misuse of the Platform or violation of these Terms, subject to applicable laws.

16. DATA PRIVACY

Personal data is processed in accordance with the Philippine Data Privacy Act of 2012 (RA 10173) and Qumpra.com’s Privacy Policy.

17. TERMINATION

Qumpra.com may suspend or terminate access for violations, fraud, or security concerns, with or without prior notice as allowed by law.

18. GOVERNING LAW

These Terms are governed by and construed in accordance with the laws of the Republic of the Philippines.

19. CHANGES TO TERMS

Qumpra.com may modify these Terms at any time. Continued use of the Platform constitutes acceptance of updated Terms.
